Following Weinstein’s email on May 23, 2017, in which he disagreed with the proposed “Day of Absence & Day of Presence,” in which white students and faculty were asked to leave campus for a day, a large group of students demonstrated outside his classroom. In response, he said he would be on campus that day. Weinstein taught biology at Washington’s Evergreen State University for the better part of three decades. He wrote The Reserve-Capacity Hypothesis in 2002, in which he argued that researchers have been underestimating the dangers of new medications to humans due to the telomeric variations between mice and people. Weinstein left Evergreen for a while to complete his doctorate in biology at the University of Michigan, where he wrote a dissertation on the topic of evolutionary trade-off mechanisms.
When Weinstein was a biology professor at Evergreen State College, he became the target of a student protest. His participation began in March of 2017 when he submitted a letter to the professors at Evergreen. His letter was a protest against a new policy that would end the decades-old practise of a “Day of Absence,” during which students and teachers from underrepresented groups would skip class to draw attention to their accomplishments at the University. Since the event has been announced to be reversed, white students and professors have been asked to not attend. Weinstein’s letter was highly critical and opposed to the shift.
Protests from students in late May 2017 disrupted school life and demanded numerous reforms in response to Weinstein’s remarks. The head of the university would not authorise police to disperse the demonstrators. When Weinstein asked for protection from university police, they informed him they couldn’t provide it and advised him to stay away from campus. As a result, he taught his biology class in a nearby park. In September of 2017, Weinstein and his wife, professor Heather Heying, agreed on a deal in which they both resigned and received payments.

People of colour at the university have had off-campus meetings on a “Day of Absence” for quite some time to talk about diversity and inclusion on campus. However, in 2017, organisers asked white students to skip the Day of Absence in favour of a programme on allies. Weinstein wrote a message on a college email group voicing his opposition to the proposed change. In addition, Weinstein argued against a suggestion by the college’s Equity and Inclusion Council regarding faculty hiring, which would have mandated a “equity justification/explanation” for all faculty hires.
Student demonstrations were extremely large and conflicts with Weinstein and other students occurred because of his views on the Day of Absence and faculty hiring. After that, demonstrators occupied the administration building. For conservatives concerned about the future of free speech in colleges, Weinstein’s trial became a cause célèbre.
Weinstein and his wife, who was also a professor at Evergreen, filed a $3.85 million lawsuit against the school in July 2017, claiming the school had failed to “protect its employees from repeated provocative and corrosive verbal and written hostility based on race, as well as threats of physical violence.” Without admitting fault, Evergreen paid the Weinsteins $500,000 in September as part of a settlement. Weinstein and his wife’s resignations from their academic posts were a condition of the settlement.
